Returns, Refunds and Limited Warranty Policy

This Returns, Refunds and Limited Warranty Policy ("Policy") applies to purchases from Warmelle, a trading name of [LEGAL NAME] ("Warmelle," "we," "us," or "our"). It forms part of our Terms of Service. By placing an order, you agree to this Policy. If you live in the United Kingdom, Section 11 also applies to you and prevails wherever it gives you more rights.

1. Choosing your version

Warmelle belts come in two versions: Heat Only, which heats but does not massage, and Heat + Massage. Please check the version you select before you place your order. Choosing the wrong version is not a defect. It is treated as a change of mind under Section 2, and you can ask us about an exchange under Section 9.

2. Returns for change of mind

You may request a return within 14 days after your order is delivered (the "Return Window"). Requests made after the Return Window are accepted only where required by law.

Because the belt is worn close to the body, for hygiene reasons we accept change-of-mind returns only for items that are unused and unworn, in their original packaging, and with all parts and accessories, including the controller, the power adapter and the manual. We may refuse a return, or reduce your refund, if the item has been used, worn, damaged, altered, returned incomplete, or handled more than necessary to inspect it. This paragraph does not limit the rights of customers in the United Kingdom described in Section 11.

You are responsible for the cost of return shipping, including any customs duties, taxes or fees, for returns made because you changed your mind. We recommend a tracked and insured shipping service, because we are not responsible for returns that are lost or damaged in transit, and we cannot issue a refund for items we do not receive.

3. How to start a return

All returns require our prior approval. To request one, email us at contacto.warmelle@use.startmail.com with your order number, the items you wish to return, the reason, and photos or video if the item is damaged or defective.

If your return is approved, we will send you instructions and the address to which you must send your package, and you must ship it within 14 days after our approval. Items sent back without first requesting and receiving approval, to a different address than the one we provide, or after that period will not be accepted or refunded, and we are not responsible for them.

4. Damaged, defective or incorrect items

Please inspect your order when you receive it. If an item arrives damaged, does not work, or is not the version you ordered, contact us within 7 days after delivery and include your order number and photos or video of the item, its packaging and the shipping label. We will, at our option, replace the item or refund you. If we ask you to send the item back, return shipping is free and we will provide a return label. We may choose to waive the return of the item. Problems that appear later are covered by the Limited Warranty in Section 5.

Before you report that your belt does not turn on or does not heat, please check these steps from the product manual:

- Use only the 24V 3A power adapter supplied with the belt, plugged into a wall outlet. The belt is not wireless and does not work with power banks.
- Press and hold the button for 3 seconds to turn it on.
- If it is not warm enough, use the high setting.
- If it switches off while you are using it, check that the adapter is still plugged in.
- Check the cord for any damage. If it is damaged, stop using the belt and contact us.

5. Limited 90-day warranty

Warrantor:Jose Luis Galindo , trading as Warmelle, Calle Linos 9 G, 28430 Madrid, Spain. Email: contacto.warmelle@use.startmail.com.

What is covered. We warrant that the belt, controller and power adapter you purchased from us will be free from defects in materials and workmanship under normal use, in accordance with the product manual, for 90 days after the date of delivery. This warranty applies to products bought from our online store and delivered to the United States or the United Kingdom. It covers defects and breakdowns, such as the belt not heating or, on the Heat + Massage version, the massage not working. It is not a satisfaction guarantee and does not cover a change of mind, which is governed by Section 2.

Your remedy. If a covered defect appears during the warranty period, we will, at our option, repair the product, replace it, or refund the purchase price. To the extent permitted by law, this is your exclusive remedy under this warranty. A replacement product is covered for the remainder of the original warranty period.

How to make a claim. First follow the steps in Section 4. If the problem continues, email us at contacto.warmelle@use.startmail.com within the warranty period with your order number, a description of the problem, and photos or video showing the belt connected to its original adapter and a wall outlet. We may ask you to return the product. If we do, we will pay for return shipping and provide a label. We may waive the return of the product.

What is not covered. This warranty does not cover: normal wear and tear; damage caused by misuse, abuse, neglect, accident, or failure to follow the product manual and its warnings; use with a power adapter other than the one supplied, with a power bank, or with a damaged cord; ironing, dry cleaning or any other care not allowed in the product manual; cuts or other damage to the cord, plug or controller after delivery; unauthorized repairs or modifications; or cosmetic changes that do not affect how the product works.

The next two paragraphs apply to customers in the United States.

Disclaimer of other warranties. EXCEPT FOR THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED. ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Limitation of damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING FROM THE BREACH OF THIS WARRANTY OR ANY IMPLIED WARRANTY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Your other rights. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. If you live in the United Kingdom, you also have statutory rights for goods that are faulty or not as described, and this warranty does not affect them (see Section 11).

6. Cancellations

You can request cancellation or removal of items from your order until the item is shipped, by emailing us at contacto.warmelle@use.startmail.com with your order number. Once an order has shipped, it can no longer be cancelled and is handled as a return under Section 2, or under Section 11 if you live in the United Kingdom.

7. Non-returnable items

The following cannot be returned or refunded for change of mind:

- Free gifts and bonus items included with your order, such as the ebook, the surprise gift and the priority shipping upgrade. They are part of a promotional offer tied to the qualifying purchase and cannot be returned, exchanged or refunded separately. If you return the qualifying purchase, the free gifts are forfeited, and any physical gifts must be returned together with it.
- Digital products, such as ebooks, once delivered or accessed.
- Items marked as non-returnable on the product page at the time of purchase.

Physical products remain covered by Sections 4 and 5, and customers in the United Kingdom keep their rights under Section 11.

8. Promotional offers

If your order included a discount, bundle or promotional offer, a partial return is refunded by recalculating the order. The offer applies only to the items that still qualify, and your refund is the amount you paid minus what you would have paid for the items you keep.

9. Exchanges

If you would like the other version, contact us before returning anything. Exchanges are subject to availability and may be processed as a return and a new order.

10. Refunds

We will email you after we receive and inspect your return to let you know whether the refund was approved or denied. If approved, we will refund you to your original payment method within 10 business days after approval. For cancellations by customers in the United Kingdom, the timing in Section 11 applies. Your bank or payment provider may need additional time to process and post the refund.

Refunds cover the price of the returned item and any tax charged on it. Original shipping charges, and any customs duties or import taxes you paid, are not refundable, except where the item was defective, damaged or incorrect, where we made an error, or where the law requires otherwise. Refunds are issued in the currency of the original payment, and we are not responsible for exchange-rate differences or bank fees. If a return does not meet the conditions of this Policy, we may issue a partial refund or deny the refund, and we may send the item back to you at your expense.

If you do not see your refund within 10 business days after we told you it was approved, contact us.

11. Customers in the United Kingdom

Your right to cancel. If you are a consumer in the United Kingdom, you have the right to cancel your order within 14 days without giving any reason. The cancellation period ends 14 days after the day on which you, or someone you name, receive the goods. If your order arrives in several deliveries, it ends 14 days after the day you receive the last one.

How to cancel. Tell us clearly before the cancellation period ends, by email to contacto.warmelle@use.startmail.com. You can use the model cancellation form at the end of this Policy, but you do not have to.

Returning the goods. You must send the goods back to the address we give you without undue delay, and no later than 14 days after the day you tell us you are cancelling. You pay the direct cost of returning the goods, unless they are faulty or not as described.

Handling the goods. You may handle the belt only as you would in a shop, to check its nature, characteristics and how it works. Because it is worn close to the body, if you wear or use it beyond that, we may reduce your refund to reflect the loss in its value, up to its full price.

Your refund. We will refund the price you paid and the cost of standard delivery, using the same payment method you used, within 14 days after we receive the goods back or after you give us evidence that you have sent them back, whichever is earlier. If you chose a delivery option more expensive than our least expensive standard delivery, we will not refund the extra cost. We will not charge you any fee for the refund.

Faulty goods. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you can reject them for a full refund within 30 days after delivery. After that, or if you prefer, you can ask for a repair or a replacement, and if that is not possible or does not fix the problem, you can ask for a price reduction or a refund. If a fault appears within 6 months after delivery, it is presumed to have been there at delivery unless we prove otherwise. You can make a claim up to six years after delivery (five years in Scotland). This is a summary of your main rights. For more information, visit Citizens Advice. The Limited Warranty in Section 5 is in addition to these rights and does not affect them.

12. Payment disputes

If you have a problem with your order, please contact us before disputing a charge with your bank or card issuer. We will work to resolve it quickly. If you file a dispute without contacting us first, resolution may take longer, and we may provide your bank or payment processor with proof of delivery, our communications with you, and this Policy.

13. Abuse and fraud

We reserve the right to refuse returns, refunds or warranty claims, to cancel orders, and to limit or refuse future orders where we reasonably suspect fraud, abuse of this Policy, or a pattern of excessive returns, to the extent permitted by law.

14. Your legal rights and changes to this Policy

This Policy does not limit any rights you may have under applicable consumer protection laws, including rights that may apply if goods are defective, not as described, not delivered within the required or agreed timeframe, or otherwise do not comply with applicable law. Nothing in this Policy excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under applicable law. Subject to that, and to the maximum extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product.

We may update this Policy from time to time. Changes apply to orders placed after the "Last updated" date above.
